1. Purpose

These Terms and Conditions of Sale define the rights and obligations of the parties in connection with the online sale of products and services offered by Bixar via the website bixar.fr.

2. Products and availability

• The essential characteristics of the products are presented on each product page.
• Offers are valid for as long as they are visible on the website, while stocks last.
• In the event of unavailability after ordering, we will inform you by email and will either issue a refund or set a new delivery date.

3. Prices

• Prices are expressed in euros, including VAT.
• Delivery charges are indicated separately before the order is confirmed.
• We reserve the right to change prices at any time, but products are invoiced on the basis of the price in force at the time the order is confirmed.

4. Order

• Any order constitutes acceptance of these Terms and Conditions of Sale.
• The ordering process includes several confirmation steps in order to check and correct any errors.
• Once the order has been confirmed and payment has been confirmed, you receive a confirmation email.

5. Payment

• Payments are made online by bank card, or by the other means of payment displayed when ordering.
• Payment is debited immediately upon confirmation of the order.
• Your payment data is processed securely by our provider Stripe and is not stored by Bixar.

6. Delivery

• The delivery conditions (lead times, zones, charges) are specified in our Delivery Policy.
• The transfer of risk takes place upon receipt of the parcel by the customer.

7. Right of withdrawal

• In accordance with the Code de la consommation, you have a period of 14 days from receipt to exercise your right of withdrawal, without having to give reasons for your decision.
• To exercise this right, contact us at bixar@bixar.co.
• Returns must be made under the conditions specified in our Returns Policy.
• Exceptions: digital services or subscriptions activated immediately (e.g. 4G/eSIM connectivity) are not refundable once performed with your agreement.

8. Legal guarantees

Our products automatically benefit from:

• the legal guarantee of conformity (articles L217-3 et seq. of the Code de la consommation);
• the legal guarantee against hidden defects (articles 1641 to 1649 of the Code civil).

Extracts:

• Article L217-3 C. conso.: “The seller shall deliver goods in conformity with the contract and shall be liable for any lack of conformity existing at the time of delivery.”
• Article 1641 C. civ.: “The seller is bound by a warranty against hidden defects in the thing sold.”

9. Liability

• We cannot be held liable in the event of misuse of the product, normal wear and tear, or negligence on the part of the customer.
• In the event of force majeure (strikes, disasters, health crises, etc.), our obligations are suspended.

10. Applicable law and disputes

• These Terms and Conditions of Sale are governed by French law.
• In the event of a dispute, an amicable solution will be sought.
• In accordance with the Code de la consommation, you may have recourse, free of charge, to an approved consumer mediator before taking any legal action.
• Failing this, the French courts will have jurisdiction.
